BART Technologies Inc. ("Company", "we", "us", "our") operates the BART application (the "Application" or "Service"). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our Application.

By using the Application, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree, please do not use the Application.

This Privacy Policy applies to information collected from registered users of the Application (typically insurance brokers and their staff). Where the Application is used to publish content to non-registered viewers (for example, employees of a broker's client accessing an Employee Benefit Center portal), Section 11 describes how those viewers' information is handled.

Sub-processors are bound by written agreements that require them to protect information consistent with this Privacy Policy and applicable law. A current list of sub-processors is available on request.

3.5 Sharing You Initiate

The Application enables you to share content with third parties — for example, by generating share links for reports, publishing Summary of Benefits and Coverage (SBC) QR codes, or publishing an Employee Benefit Center portal to your clients' employees. When you initiate such sharing, the recipients (and, where applicable, anyone with the share link) may access the content you have selected. You are responsible for selecting appropriate share permissions, expiration windows, and audience controls. Section 11 describes how viewers of published portals are handled.

No method of transmission over the Internet or electronic storage is, however, 100% secure, and we cannot guarantee absolute security. In the event of a security incident that materially affects your information, we will notify you in accordance with applicable law and, where a Business Associate Agreement is in effect, in accordance with that agreement's breach-notification provisions (see Section 10).

You may opt out of marketing emails by using the unsubscribe link in any marketing message or by updating your communication preferences in your account settings. We honor opt-outs promptly and maintain a suppression list to prevent re-mailing.

The Application is not intended for use by individuals under the age of 18. We do not knowingly collect personal information from children. If you believe we have collected information from a child, please contact us immediately.

8. AI, Machine Learning, and Conversational Features

The Application uses artificial intelligence and machine learning to provide analysis, recommendations, document parsing, and conversational features (including in-app chat and contextual command interfaces). The following describes how AI-related data is handled:

9. International Data Transfers

Your information may be transferred to and processed in countries other than your country of residence. We ensure appropriate safeguards are in place for such transfers in compliance with applicable data protection laws, including, where applicable, Standard Contractual Clauses for transfers from the EEA or United Kingdom.

10. HIPAA and Protected Health Information

Information related to an individual's health, treatment, or payment for health care, when combined with identifiers, may constitute Protected Health Information ("PHI") under the U.S. Health Insurance Portability and Accountability Act of 1996 ("HIPAA"). Census files and other documents you upload may contain such information.

10.1 Default Position

Without an executed Business Associate Agreement ("BAA") between you (or your organization) and BART Technologies Inc., BART is not acting as a HIPAA Business Associate. In that case, you agree not to upload PHI to the Application, or to de-identify such information in accordance with 45 C.F.R. § 164.514 before upload.

10.2 BAA Available on Request

BART Technologies Inc. makes a BAA available to qualifying customers (typically enterprise customers and Covered Entities or their Business Associates). When a BAA is executed, the terms of that BAA govern PHI handling and supersede any conflicting provisions of this Privacy Policy with respect to PHI. To request a BAA, contact privacy@trybart.com.

10.3 Safeguards

Whether or not a BAA is in place, BART maintains administrative, physical, and technical safeguards consistent with the HIPAA Security Rule as a baseline, including those described in Section 4.

11. Shared Knowledge, Published Portals, and External Viewers

11.1 Shared Knowledge Base

The Application includes features that draw on a shared knowledge base derived from public benefits information, carrier documentation, and aggregated and de-identified signals from customer activity. This shared knowledge is used to provide more accurate parsing, recommendations, and answers across all customers. Personally identifiable information and PHI are excluded from the shared knowledge base. You may opt out of contributing aggregated signals to the shared knowledge base in your account preferences.

11.2 Published Portals (Employee Benefit Center)

The Application allows brokers to publish portals (for example, an Employee Benefit Center, or "EBC") that present benefits information to their clients' employees. When you access a published portal as an employee or other viewer:

When you access content through a share link or QR code, we may log the access event for security and abuse-prevention purposes. Share links may expire or be revoked by the original sharer.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. For material changes, we will provide reasonable notice (for example, in-app notice or email) before they take effect. Continued use of the Application after changes constitutes acceptance of the updated Privacy Policy.

13. Versioning and Acceptance

Each effective version of this Privacy Policy is identified by an internal version identifier. When you accept this Privacy Policy — for example, by signing in to the Application — we record the version identifier of the policy in effect at the time of acceptance, together with the time of acceptance. Prior versions are available on request.
