These Terms of Service (the “Terms”) govern access to and use of the BART application, services, APIs, documentation, and related materials (collectively, the “Service”) operated by BART Technologies Inc. (“Company”, “we”, “us”). By using the Service, you accept these Terms. If you do not agree, do not use the Service.
You must be authorized to use the Service and keep credentials secure.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes. We and our licensors retain all rights, title, and interest in the Service, its code, models, and content. No rights are granted by implication.
Subject to these Terms and payment of any fees, you may use outputs generated for you for internal business purposes. You may not: (a) publicly post or commercialize outputs in a way that competes with the Service; (b) use outputs to create datasets for model training; or (c) misrepresent outputs as professional advice.
You grant us a limited license to host, process, and transmit data you provide solely to operate and improve the Service. You represent you have all necessary rights and notices for that data.
Non-public information you receive about the Service (including code, models, pricing, performance, and benchmarks) is confidential. You will not disclose or use it except to exercise rights under these Terms. We will protect your confidential information with reasonable safeguards.
The Service may interoperate with third-party services; their terms and privacy policies apply to their components. You are responsible for enabling and managing such integrations.
Our Privacy Policy describes how we collect, use, and protect data. By using the Service, you agree to it.
We may modify, suspend, or discontinue the Service (or any feature) with notice where practical. We are not liable for unavailability or delays.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. YOU ARE RESPONSIBLE FOR VALIDATING OUTPUTS AND MAKING FINAL DECISIONS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED AMOUNTS PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.
You will indemnify and hold harmless BART Technologies Inc. and its affiliates, officers, employees, and agents from claims, damages, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, violation of these Terms, or infringement of others’ rights.
We may suspend or terminate access if you breach these Terms, if required by law, or to address security or operational risk. Upon termination, rights and licenses granted to you end immediately.
Breach of Sections 2–6 may cause irreparable harm; we may seek injunctive or equitable relief without posting bond. Sections 2–6 and 10–15 survive termination.
These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law principles. The state and federal courts located in Georgia have exclusive jurisdiction.
We may update these Terms; the “Last updated” date shows the effective date. Continued use after changes become effective constitutes acceptance.
